Political and Financial Conundrums in Post-Colonial Togo

The scandal hit Lomé at the end of July, this year. According to the NGO Global Financial Integrity, Togo is the African country most affected by the ‘Panama Papers’ affair concerning tax evasion and the questionable financial operations of off-shore jurisdictions and companies. The dangerous liaisons of businessmen and public authorities regarding the exploitation of Togolese natural resources has been uncovered by newspapers Le Monde (France) and L’Alternative (Togo), following the revelation by a Washington-based network of journalists (ICIJ) of documents belonging to the Panama-based law firm Mossack Fonseca. The leak, involving the alleged participation as shareholders of the Prime Minister Selom Komi Klassou and other officials, is a harsh blow to a system and Government pressured increasingly by the opposition alliance to accept the commitments of the past ten years for the necessary reforms that could lead the country towards a more pluralist system.

Not unlike other African countries, the modern history of Togo is troubled with ambivalent efforts to overcome the remnants of colonialism and build an inclusive nation along the lines of a global liberal political culture sustained by great powers and international organisations alike. For centuries, the European presence was limited to the trading and trafficking activities on the coast. Then, in 1884, the German explorer Gustav Nachtigal signed a protectorate agreement with a local chief and, as an outcome of the Conference of Berlin (1885), the country saw its colonial rights to that area recognised. Togoland became thus a German colony until WWI, at the end of which Britain and France divided it and had their political control authorised by the League of Nations in the form of newly created mandates. Present day Togo attained independence in 1960 and was built along the borders of the French mandate, while British Togo joined the Golden Coast to form the new independent state of Ghana. After two coup d’états (1963 and 1967) and the killing of the first elected president (1963), Togo entered the era of dictatorship under Eyadéma Gnassingbé that lasted until his death, in 2005.

Like in other parts of the developing world, the financial difficulties of the 1980s and the need to get financial assistance from financial organisations, led to a first opening up of the Gnassingbé regime that eventually had to recognise the opposition and move away from the one-party system. After two months of violence, the regime accepted a national conference (1991) with limited powers to negotiate the transition but it was not ready to share power with its political opponents. Supported by the army, Gnassingbé was able to undermine the conference and even cancel it one day before its official conclusion. With a new constitution approved (1993) by referendum and his powers virtually untouched, Gnassingbé provided the international community with the semblance of democracy it had asked for and thus granted the lasting support of France.

The political troubles of the last ten years in Togo started with Gnassingbé’s death and replacement in 2005. In an act of indefectible support, the chief of the Togolese army Zakary Nandja pronounced his son Faure Gnassingbé as the new president of Togo even if, due to internal and international contestation, he had to step down and take part in presidential elections that same year. Faure Gnassingbé won officially the elections with 60% of the votes, but the whole process was marked by violence in Lomé opposing the supporters of the opposition to the police (about 800 dead), while thousands fled to Ghana and Benin. The aftermath showed some political will to negotiate a new way forward, as the new president understood he had to consolidate his power on a reconstructed legitimacy. A national dialogue was initiated that led to the signing, on 20 August 2006, of a global political agreement (APG) under the mediation of the president Campaoré of Burkina Faso. After ten years though, this agreement is still at the centre of political struggle between the Gnassingbé regime and the opposition, as the latter assert nothing has been done in terms of political, electoral and institutional reforms due to the regime’s lack of political will to move forward. While at the National Assembly the president uses the majority party UNIR to block the opposition’s initiatives and delay the reform programme, a new institution HCCRUN has been launched recently to revamp the process. To the opposition leaders nonetheless, this is but one more dilatory move made by the regime to boycott the reform cycle by bringing again to the negotiation table what was already negotiated and decided at the 2006 APG.

At a political meeting organised by the opposition platform ‘CAP 2015’ on 20 August 2016 to mark the tenth anniversary of the APG, the opposition leader Jean-Pierre Fabre stated that the current stalemate brings a lot of frustration to the Togolese people and could only lead to social explosion. Under banners that stressed ‘Enough is Enough’ and ‘Ten Years On: Nothing’s Done’, opposition leaders rallied to demand more transparency in the judicial and electoral systems, as well as a clarification regarding the ‘Panama Papers’ affair. Therefore, a sense of deprivation and economic injustice could add up to political frustration following the licking of this affair. Like in other developing countries, natural resources are at the centre of a lucrative business linking nationals at privileged official positions and foreign-owned companies, the whole thing boiling down to fiscal evasion and the defence of corporate interests at the expense of the general interest. The story can be told briefly. At the centre of the scandal there is Wacem, a cement company owned by two Indian nationals, owning also Togo-Rail and Amexfield Togo Steel, and who have just been exposed as holders of shell companies in tax heavens for dubious purposes such as tax evasion. The Wacem affair is particularly troubling because limestone has been massively exploited in the last 10 years, ending up outdoing phosphate today as the top extractive industry in Togo. Moreover, Wacem profits from a tax free status and as a result of that, limestone extraction activities, both mechanical and financial, have been under poor scrutiny to say the least. Connected to the deprivation of the national treasury though is the fact that local communities have not secured any sustainable advantage from this extractive massive activity; on the contrary, they have seen their natural resources drained on behalf of foreign corporate interests.

After 55 years of political independence then, Post-colonial Togo is a country still struggling hard with the vicissitudes of development. Partly, the constraints have to do with an international system producing and distributing inequality among its members. However, the political game set up in post-colonial Togo, linking private and corporate interests as in most developing countries, has added an extra layer of deprivation and inequality working to the people’s disadvantage. One can argue the regime has opened up since Eyadéma Gnassingbé’s death and that his son acts more like a technocratic and developmentalist leader than a dictator. However, the still highly opaque nature of the regime, as well as the weakness of civil society, are at the same time a shelter to corporate interests feeding abusively on the state as well as tough obstacles to redirect public investment to where it is most needed, viz. public policies such as education, health, water and sanitation, job creation, the habitat and environmental sustainability.

Avortement ou mort sociale : les droits des prisonniers au Togo

La semaine dernière, je suis allée visiter la prison civile de Lomé. Ma mission : rencontrer et interroger les femmes enceintes ou accompagnées d’enfants (oui, vous avez bien lu, les femmes sont fréquemment forcées de garder leurs nouveau-nés avec elles en prison). Ces interviews feront par la suite partie de la campagne que le CACIT (le Collectif des Associations contre l’Impunité au Togo) mène pour susciter une prise de conscience des droits des prisonniers au Togo.

Ce jour-là, j’ai interrogé une femme en particulier, que j’appellerai Claudia (son nom a été modifié). Claudia a une vingtaine d’années et elle est mariée. Elle est en prison depuis plusieurs mois et n’a pas encore pu consulter un avocat. Elle ne sait pas quand son procès aura lieu, s’il a lieu un jour. En fait, elle n’a même pas connaissance des charges qui sont retenues contre elle. Cependant, elle sait pourquoi elle est en prison. Elle est en prison car elle a essayé d’avorter.

Claudia est maintenant à six mois de grossesse. Elle espère qu’elle sera libérée avant son accouchement, mais c’est peu probable. Si elle est toujours en prison dans trois mois, elle ne sera pas avec son mari pendant l’accouchement. Elle n’aura pas plus de nourriture ni plus d’eau pendant sa grossesse ni une fois que l’enfant sera né. Elle ne pourra pas consulter de médecin pendant la grossesse, ni aller à l’hôpital pour accoucher.

Le CACIT a recueilli le témoignage d’une autre femme, appelons-la Elise. Elise s’est vu accorder le « privilège » d’aller à l’hôpital quand elle a ressenti les premières contractions. Elise est restée allongée sur le sol, ignorée par les médecins et le personnel médical. Pendant tout l’accouchement, Elise est restée menottée, les mains dans le dos. Quand son enfant est né, elle n’a pas pu le prendre dans ses bras ni le nourrir, puisque ses mains sont restées attachées derrière son dos. C’est ce qui attend Claudia. Si Claudia et son enfant survivent à l’accouchement, elle sera très probablement obligée d’élever son enfant en prison pour les premières années de sa vie.

Vous vous demandez comment une telle chose est possible ? Comment des êtres humains dotés de la raison, de bon sens et de sentiments peuvent-ils penser que donner la vie et élever un enfant en prison est mieux que d’avorter ? Pour répondre à cette question, il faut en savoir un peu plus sur le Togo.

Le Togo, le plus petit pays d’Afrique de l’ouest, a aujourd’hui un des plus hauts taux de besoin en moyens de contraception. Moins de 10% des 6,6 millions de Togolais ont actuellement un accès et utilisent régulièrement un moyen de contraception. Par conséquent, les avortements illégaux sont monnaie courante, et de plus en plus risqués.

En 1981, le Togo a abrogé le Code pénal français en vigueur. Ce code rendait toutes formes d’avortement et de contraception illégales. Cette interdiction concernait également la publicité, la production, le transport, la vente et l’importation de contraceptifs. Ces lois n’ont pas immédiatement été remplacées par des lois togolaises sur l’avortement et la contraception, et pendant une période tous deux étaient considérés comme légaux. Cependant, la majorité de la population a toujours une position très hostile à l’avortement et à la contraception – l’héritage de la législation coloniale française.

De ce fait, en 2006, le législateur togolais a pris une loi disposant que « l’interruption volontaire de grossesse n’est autorisée que lorsqu’elle est prescrite par un médecin et à la demande de la femme, lorsque la grossesse résulte d’un viol ou d’une relation incestueuse ». De plus, dans tous les cas, la loi exige que la femme obtienne le consentement de sa famille. Tous les individus impliqués dans un avortement illégal peuvent, en application de cette loi, être condamnés à une peine d’amende et à 5 ans d’emprisonnement.

Si Claudia obtient un jour un procès, telle est la peine qu’elle encourt – 5 années de prison supplémentaires et une amende. Par ailleurs, l’enfant de Claudia devra faire face à ce que l’on appelle la « mort sociale ». Parce que l’enfant est né en prison, il est peu probable qu’il obtienne un acte de naissance, ce qui signifie qu’il ne sera pas en mesure d’être adopté, ni même vacciné. Par la suite, il sera difficile pour Claudia de scolariser son enfant. Sans éducation, l’enfant sera plus susceptible d’être victime du trafic d’êtres humains et du travail forcé. Dès sa naissance, l’enfant de Claudia sera privé de la personnalité juridique et d’une existence sociale.

L’Organisation des Nations Unies (ONU) reconnaît aux femmes le droit d’avorter si l’enfant n’est pas désiré, et ce, quelle qu’en soit la raison. Je ne peux qu’espérer qu’un jour, le Togo leur reconnaîtra également ce droit. Aucune femme ne devrait avoir à choisir entre l’avortement ou la mort sociale de son enfant.

Abortion or Social Death: Prisoners Rights in Togo

Last week, I visited the civil prison in Lomé, Togo. My job: to seek out and interview pregnant women or women with children (yes, you read that right, women are frequently forced to keep their infant children with them in prison). These interviews will later become part of a campaign that CACIT (Le Collectif des Associations contrel’Impunité au Togo) is running to raise awareness about the rights of prisoners in Togo.

On that day last week, I interviewed one woman in particular, who I will call Claudia (not her real name). Claudia is in her mid-twenties and she is married. She has been in prison for several months and has yet to meet with a lawyer. She has no idea when her case will go to trial, if ever. In fact, she hasn’t even heard her formal charges. Claudia knows why she’s in prison though. She’s in prison for trying to get an abortion.

Claudia is now 6 months pregnant. She hopes she’ll be released before she gives birth, but it’s unlikely. If she’s still in prison in three months, she will not be with her husband during labor. Claudia will not receive extra food or water during pregnancy or when the child is born. She will not have access to a doctor during pregnancy, or go to a hospital during labor.

CACIT has testimony from another woman; let’s call her Elise. Elise was granted the “privilege” of going to the hospital when she went into labor at the Lomé prison. Elise lay on the ground, ignored by doctors and hospital staff. For hours of labor, Elise was kept handcuffed with her hands behind her back. When Elise’s baby was born, she could not hold them or feed them because her hands were kept locked behind her. This is the fate that may await Claudia. If Claudia and her child survive labor, she will most likely be forced raise the child in prison for the first years of their life.

How is this possible, you ask? How can reasonable, thinking, feeling humans truly believe that giving birth and raising a child in prison is truly better than having an abortion? To answer this question, you need a bit of background about Togo.

Togo, the smallest country in West Africa, today has one of the world’s highest levels of unmet need for contraception. Less than 10% of the 6.6 million people in Togo currently have access to and use contraception regularly. As a result, illegal abortion has become increasingly common and increasingly unsafe.

In 1981, Togo repealed the existing French Penal code. This code contained language making all abortions and all forms of contraception illegal. This contraceptive ban included the advertisement, manufacture, transport, sale and importation of contraceptives. These laws were not immediately replaced with Togolese laws about abortion or contraception, and so for a time both were considered fully legal. However, most of the population retained extremely conservative views regarding abortion and contraception- the vestiges of French colonial rule.

As a result, in 2006, Togolese lawmakers passed a law stating, “voluntary interruption of pregnancy is only authorized when prescribed by a doctor and on request of the woman in cases where the pregnancy is the result of rape or of an incestuous relationship.” Further, the law requires that the woman obtain the permission of her family in all cases. All individuals involved in illegal abortions could, as per this law, face fines and up to five years in prison.

If Claudia ever goes to trial, this is the fate that awaits her- an additional five years in prison and fines. Claudia’s child, on the other hand, will face what academics have termed Social Death. Because the child was born in prison, they will most likely not receive a birth certificate, which means they are not eligible for adoption or vaccination. Later, Claudia will find it difficult to enroll her child in school. Without an education, the child becomes much more likely to become a victim of human trafficking or child labor. Claudia’s child will effectively be erased the moment they’re born.

The United Nations recognizes a woman’s right to choose to abort an unwanted child for any reason. I can only hope that, in time, Togo will recognize this right as well. No woman should ever have to choose between abortion and social death for her child.
